Welcome to Poetix® Store, operated by Poetix OÜ, an Estonian-registered company.
Throughout this document, “we”, “us” and “our” refer to Poetix® Store.
Poetix® Store operates this website and related digital platforms, including all content, tools, and services (the “Services”).
The Store is powered by Shopify and supported by authorized fulfillment partners, enabling us to deliver both digital and physical products securely and efficiently.

By visiting or purchasing from our Store, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree, do not use or access our Services.

1 – ELIGIBILITY & ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your country of residence.
You agree to provide accurate, complete, and current information and to maintain the confidentiality of your account credentials.
You may not sell or transfer your account to any third party.

2 – DIGITAL PRODUCTS (Instant Access)

Our digital products include e-books, downloadable guides, audio or visual materials, and password-protected content.
Once a digital file or access link has been delivered, the order is considered fulfilled and non-refundable.

Under Article 16(m) of the EU Consumer Rights Directive, you acknowledge that by purchasing digital content with immediate access, you waive your statutory right of withdrawal.

Permitted Use

Purchased digital materials are licensed for personal, non-commercial use only.
You may not share, resell, reproduce, or redistribute any digital file without written consent from Poetix OÜ.
Violation of this license may result in immediate termination of access and legal action.

Technical Support & Exceptions

If a digital file fails to download or is corrupted, contact info@poetix.eu within 7 days.
We will verify and reissue access or issue a refund only in cases of proven technical error, duplicate payment, or defective file.

3 – PHYSICAL PRODUCTS (Dropshipping Items)

Our physical items are fulfilled through verified international warehouses and dropshipping partners.
Estimated delivery times are displayed at checkout and may vary depending on your region and customs processing.

Right of Withdrawal (EU Consumers)

You may withdraw from the contract within 14 days of receiving your goods without stating a reason.
To initiate a return, contact info@poetix.eu within the withdrawal period.

All returns must be authorized in advance.
Because fulfillment occurs through multiple partner warehouses, you will receive the correct return address and instructions after contacting us.
Unauthorized returns cannot be processed.

Returned items must be unused, in original packaging, and accompanied by proof of purchase.

Returns and refunds are managed by Poetix OÜ in coordination with our authorized fulfillment partners.
You will receive region-specific instructions once your request is approved.

4 – PRICES & PAYMENT

All prices are listed in EUR (€) and include applicable VAT based on the customer’s location in accordance with the EU OSS system.
Prices may change without notice; the price at checkout applies.
You agree to provide valid payment details.
Transactions are securely processed via Shopify Payments, Wise, or PayPal Business.

5 – DELIVERY & RISK OF LOSS

We aim to dispatch orders promptly through verified carriers.
Estimated delivery times are not guaranteed.
We are not liable for delays caused by customs, carriers, or events beyond our control.

Under Article 20 of the EU Consumer Rights Directive, risk of loss passes to you only when you or a third party designated by you (other than the carrier) physically receive the goods.
If you select your own carrier, risk transfers when the goods are handed to that carrier.

6 – INTELLECTUAL PROPERTY

All digital and physical product designs, texts, graphics, and media are the exclusive property of Poetix OÜ and protected by international copyright and trademark law.
You receive a limited, non-transferable, personal license to use purchased content.
Poetix®, The Poetry in Movement Breath Balance™, and associated marks are registered or pending trademarks of Poetix OÜ.

7 – THIRD-PARTY TOOLS & LINKS

Our Services may contain integrations, widgets, or links to third-party sites (e.g., Shopify, Etsy, Amazon KDP).
We are not responsible for their content, accuracy, or data practices.
Use of any third-party tool is at your own discretion.

8 – FEEDBACK & REVIEWS

If you submit testimonials, comments, or feedback, you grant Poetix OÜ a perpetual, royalty-free, worldwide license to use that material for marketing or service improvement.
Do not submit content that is defamatory, unlawful, or infringes intellectual property rights.

9 – PROHIBITED USES

You agree not to:

Copy, share, or redistribute digital files.
Upload malware or harmful code.
Use the Services for fraudulent, misleading, or unlawful purposes.
Infringe intellectual property rights of others.
Violation of these rules may result in suspension or termination.

10 – DISCLAIMER OF WARRANTIES

All Services and products are provided “as is” and “as available.”
We make no warranties that access will be uninterrupted or error-free, or that defects will be corrected.
Your use of our materials is at your own risk.

11 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, Poetix OÜ and its affiliates shall not be liable for any indirect, incidental, or consequential damages—including lost profits, lost data, or loss of use—arising from the use of our Services or products.

12 – INDEMNIFICATION

You agree to indemnify and hold harmless Poetix OÜ and its partners from any claims arising from your breach of these Terms or misuse of our Services.

13 – TERMINATION

We may suspend or terminate your account at any time for violating these Terms.
Sections relating to intellectual property, liability, and governing law survive termination.

14 – SEVERABILITY

If any clause is held invalid or unenforceable, the remaining clauses remain in effect.

15 – WAIVER & ENTIRE AGREEMENT

Failure to enforce any provision does not constitute a waiver.
These Terms and referenced policies constitute the entire agreement between you and Poetix OÜ.

16 – GOVERNING LAW & DISPUTES

These Terms are governed by the laws of Estonia and applicable EU legislation.
Any dispute shall be resolved in the Harju County Court (Tallinn, Estonia).
EU consumers may also use the European Online Dispute Resolution Platform at https://ec.europa.eu/consumers/odr.
